This presentation will cover updates on the due diligence front regarding PFAS and emerging contaminants, associated issues with the ASTM methods, and continuing complications from the Supreme Court’s decision in Atlantic Richfield Co. v. Christian, 140 S. Ct. 1335 (2020).
This presentation will include due diligence litigation update; tailoring Phase II’s to satisfy “reasonable steps”; insurance considerations in due diligence; and considering spill reporting obligations before you drill)

This presentation will go over the basic principles and requirements of a property condition assessment, uses/needs for a property condition assessment, and how it can be another skill for a due diligence practitioner in attracting new or repeat clients. It will discuss the ASTM standard and how the baseline ASTM standard property condition assessment compares to typical industry standard reports as well as agency/state-specific reports. Additionally, the presentation will cover typical qualificaitons/experience, general fees magnitudes, client expectations/additional scopes of services, and workflow practices.
Every environmental consultant wants to know how to maximize their value-added services to provide what their client needs. We will discuss how property owners, developers, lenders, attorneys and others who regularly engage environmental consultants to generate Phase I ESAs, Phase II investigations, etc., assess the information you provide and the types of decisions they need to make based on your information and recommendations. Learn the critical questions to ask about your client’s goals (flip vs long term investment, future use – residential, mixed-use or industrial/commercial, pursue voluntary closure/NFA or not, etc.); how to align your services with the client (developer, lender, buyer or seller); why providing ‘helpful information’ can be counter-productive; common Phase I mistakes; and more!
